We have expertise in the interpretation of wills, Powers of Attorney and Advance Care Directives. We also specialise in the area of estate administration, which includes obtaining grants of probate in relation to high net worth and complex estates in South Australia, interstate and overseas. We assist executors with every aspect of distributing and finalising an estate.
We advise executors and trustees on their duties in administering an estate as well as advising beneficiaries and/or potential beneficiaries of their rights, particularly with respect to making an inheritance claim under the Inheritance (Family Provision) Act.
In the case of disputed wills (including where interpretation of the will is required or the validity of the will is in question), our team members are qualified to advise on the resolution of disputes and if necessary, mediation or court proceedings to achieve a fair outcome and to protect beneficiaries.
If a person dies without leaving a will we are able to advise on how the law says the estate is to be divided and who has the right to administer the estate. We can apply for letters of administration which allows the estate to be administered without a will.
